Elgibility

By using MySay, you represent that

  1. all registration information submitted is truthful and accurate,
  2. you will maintain the accuracy of such information,
  3. you are the age of 13 years or older,
  4. your use of MySay does not violate any applicable law or regulation,
  5. your profile and membership may be deleted and terminated without warning at the discretion of MySay.

You are solely responsible for your interactions with other members of MySay. MySay reserves the right, but has no obligation, to monitor disputes between members.

You may not use any automated means to access MySay to access and/or collect information from it.

You also agree to comply to the Site Rules as listed in the Terms and Conditions.

Content

Your profile may not include

  1. Telephone numbers
  2. street addreses
  3. nude, obscene, lewd, violent, harassing, sexually explicit or objectionable matter.
If you do, MySay may terminate your profile and membership at our discretion

If you become aware of misuse by another MySay member, please contact MySay.

MySay may delete any content at our discretion, if we believe the material is offensive, illegal or harms the safety of any person. MySay assumes no responsibility for monitoring the site for inappropriate content or conduct.

You are solely responsible for the content you post on the MySay site, including any material or information transmitted to other members, and for your interactions with other users. MySay does not endorse and has no control over the content. Content is not necessarily reviewed by MySay prior to posting and does not reflect the opinions of MySay. MySay does not express or imply any accuracy to the reliability of the content, nor any material or information that you transmit to other members.

You retain all ownership rights to content you publish on MySay (your "Content"). However, you grant MySay a nonexclusive, royalty-free, perpetual, irrevocable, and assignable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such Content throughout the world in any media. You grant MySay and its affiliates and sublicensees the right to use the name that you submit in connection with such Content, if they choose. We can publish all or teaser portions of your Content online and offline and permit others to do the same.

Termination

You can cancel your account at any time by contacting MySay. We can cancel your account, or otherwise refuse service to you, at any time for any reason (including repeat infringement). MySay may choose to assume that you intended to terminate your account if you do not access it for more than three months. Following termination of your account for any reason (including inactivity), at their sole option, MySay and its licensees may continue or stop publicly displaying some or all of your Content.

Prohibited Activity

The following is a partial list of the kind of content that is illegal or prohibited to post on or through the MySay site. MySay reserves the right to investigate and take appropriate legal action against anyone who, in MySay's sole discretion, violates this provision, including without limitation, removing the offending communication from the MySay site and terminating the membership of such violators. Prohibited content includes, but is not limited to content that, in the sole discretion of MySay:

  1. is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
  2. harasses or advocates harassment of another person;
  3. exploits people in a sexual or violent manner;
  4. contains nudity, violence, or offensive subject matter or contains a link to an adult website;
  5. solicits personal information from anyone under 18;
  6. provides any telephone numbers, street addresses, last names, URLs or email addresses;
  7. promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;
  8. promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
  9. involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, or "spamming";
  10. contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);
  11. furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
  12. solicits passwords or personal identifying information for commercial or unlawful purposes from other users;
  13. involves commercial activities and/or sales without our prior written consent such as advertising, or pyramid schemes;
  14. links to another deal or affiliate website;
  15. includes a photograph of another person that you have posted without that person's consent; or
  16. uses sexually suggestive imagery or any other unfair, misleading or deceptive content intended to draw traffic to the profile.

Governing Law / Arbitration

This agreement is governed by New Zealand law as such laws apply to agreements entered into and to be performed entirely within New Zealand between New Zealand residents.

General

MySay and its services are provided "AS IS." We do not promise or warrant that any aspect of the site or system will work properly or will be continuously available. This agreement does not create any agency, partnership, employment or franchise relationship. Because you are not an employee, minimum wage laws do not apply to your relationship with MySay. Any unenforceable portion of this agreement shall be enforced to the maximum extent possible and the remaining portions shall be given full effect. Our failure to act in a particular circumstance does not waive our right to act with respect to that or other circumstances. We shall be excused for any problem due to a factor beyond our control.
